〔即時新聞／綜合報導〕台派組織「台灣制憲基金會」日前舉行研討會，會議中稱1952年舊金山對日和約生效，日本正式放棄台灣、澎湖列島的主權後，台灣國際法律未定、領土主權不屬於中國，應制憲成為一個正常化國家，中國國台辦今（12日）回應，稱《舊金山和約》是「非法無效的歷史廢紙」。
綜合中媒報導，中國國務院台灣事務辦公室今舉行例行記者會，有媒體提問台灣有學者以《舊金山和約》來挑戰一個中國原則，國台辦有何評論？國台辦朱鳳蓮對此表示，《開羅宣言》、《波茨坦公告》在內的一系列國際法文件，都明確無誤地確認了中國對台灣的主權，而《舊金山和約》是冷戰時期產物，聲稱此合約干涉他國內政、非法無效，中國政府從一開始就表明了絕不承認的嚴正立場。
朱鳳蓮痛批，《舊金山和約》是非法無效的歷史廢紙，拿來進行炒作，挑戰一個中國原則，是徒勞的。

"中國政府重申：臺灣是中華人民共和國領土不可分割的一部分。日本政府充分理解和尊重中國政府的這一立場，並按降伏文書所述，堅持遵循《波茨坦公告》第八條的立場。"
英文如下:
The Government of the People's Republic of China reiterates that Taiwan is an inalienable part of the territory of the People's Republic of China. The Government of Japan fully understands and respects this stand of the Government of the People's Republic of China, and it firmly maintains its stand under Article 8 of the Potsdam Proclamation.
那麼Article 8 of the Potsdam Proclamation是什麼?
The terms of the Cairo Declaration shall be carried out and Japanese sovereignty shall be limited to the islands of Honshu, Hokkaido, Kyushu, Shikoku and such minor islands as we determine.

所以如果樓上再有人用中日聯合聲明整一堆腦補幻想出來,就是常識有問題!
嚴格來說中日聯合聲明差不多是等同九二"共識"一樣的笑話!
為什麼?作為舊金山和約下article 3<<領土與託管統治>>如下:
Japan will concur in any proposal of the United States to the United Nations to place under its trusteeship system, with the United States as the sole ad ministering authority, Nansei Shoto south of 29 north latitude (including the Ryukyu Islands and the Daito Islands), Nanpo Shoto south of Sofu Gan (including the Bonin Islands, Rosario Island and the Volcano Islands) and Parece Vela and Marcus Island. Pending the making of such a proposal and affirmative action thereon, the United States will have the right to exercise all and any powers of administration, legislation and jurisdiction over the territory and inhabitants of these islands, including their territorial waters.
所以直到現在這一刻,戰後日本國是無權使用超出舊金山和約和日本和平憲法所賦予權力,意思就是是戰後日本國不存在單方承認中共中國擁有台灣主權的權力或者直接轉讓當年大日本國的繼承權,至少他要問一問美國,否則連表個態都不可以!
難怪日本是"充分理解和尊重"..........令人髮指的閱讀理解能力!
