USCIS Issues Policy Guidance Regarding Inadmissibility Based on Membership in a Totalitarian Party

On Oct. 2, USCIS issued policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. Membership in or affiliation with the Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America, which includes pledging to “support and defend the Constitution and laws of the United States.”
The new policy manual section provides guidance on how to adjudicate inadmissibility due to membership in the Communist Party or any other totalitarian party in the context of adjustment of status applications.
In general, unless otherwise exempt, any intending immigrant who is a member or affiliate of the Communist Party or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. This addition to the policy manual will help officers adjudicate this inadmissibility ground consistent with federal law.

Purpose
U.S. Citizenship and Immigration Services (USCIS) is issuing policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist or any other totalitarian party.
Background
The inadmissibility ground for membership in or affiliation with the Communist or any other totalitarian party [sup]1 [/sup]is part of a broader set of laws passed by Congress to address threats to the safety and security of the United States. [sup]2 [/sup]In general, unless otherwise exempt, any immigrant who is or has been a member of or affiliated with the Communist or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. This ground of inadmissibility only applies to aliens seeking immigrant status, such as aliens inside the United States applying to adjust status to that of a lawful permanent resident.
This guidance, contained in Volume 8 of the Policy Manual, is controlling and supersedes any related prior guidance on the topic.

传川普总统拟定禁止所有中共党员入境 退党成热搜关键字
7月16日，美国《纽约时报》引述多名消息人士透露称，川普总统为首的美国政府正在拟定禁止所有中共党员及其家属进入美国。据悉，这项政策仍在拟定草案程序中，美国政府获得授权不但可以撤销已经身在美国的中共党员及其家属的签证，将其驱逐出境，而且还禁止中共党员及其家属、中共军方人员和国营企业主管进入美国等。
由于上述政策正在拟定草案程序中，目前尚且无法确认川普总统是否会同意执行。
中共媒体《环球时报》主编胡锡进发文称，中共党员人数多达9300万，再加上他们的配偶、儿女和父母等家属，总计人数约3亿人。
综合台湾媒体报导，上述消息传出之后，中文“退党”关键字在谷歌搜素引擎上成为热搜。其中“如何退党”搜索量骤增150%，“退党流程”增加了120%，显示人在海外的中国公民非常真实的反应。
美国众议员已提出禁止中共党员移民入籍立法案
根据《美国移民和国籍法》（Immigration and Nationality Act）规定，禁止任何共产党员和恐怖主义组织成员移民美国，并获得绿卡。今年6月15日，美国众议员Guy Reschenthaler提出了《终止中共党员公民法》（End Chinese Communist Citizenship Act）立法案，此立法案明确禁止中共党员获得美国绿卡。
Guy Reschenthaler说：“中共在全球范围内继续采取侵略和粗鲁的掠夺行为，包括窃取美国知识产权、违反国际贸易法、制造令人发指的侵犯人权行为等。最近，他们没有采取任何负责任的行动，来分享可能致命性的武汉肺炎病毒（COVID-19）信息。很显然，中共党员不同意我们美国的核心价值观。（因此）我们不应该允许他们成为美国公民。”
Guy Reschenthaler表示，《终止中共党员公民法》将“中共党员或其继承人”加入到禁止成为美国公民的移民名单中，以确保中共成员不会获得绿卡。
据全球退党服务中心网站7月18日报导，中共党员退出中国共产党之后，只要出示退党证书便可以进入美国、获得绿卡或加入美国国籍。
报导引述美国移民法律条款规定，申请加入美国国籍的移民隐瞒其共产党员身份，使用欺骗手段进入美国、加入了美国籍，如果被举报并查证属实的话，不但他们随时可能被注销其绿卡，而且还会遭到驱逐出境。
美国政府承认退党证书法律效力
近年来，美国政府对中共党员移民申请的审查程序比以往要更加严格，因是中共党员身份的中国公民，他们当中有人申请移民也遭到美国移民局的拒绝。
如果移民或加入美国国籍的申请人能够证明自己是非自愿（involuntary）加入中共，或者在提交绿卡申请一定年限之前证明自己已退党，那么他们依然可以获得移民签证、绿卡，甚至可以加入美国籍。
报导称，美国移民局早些年就确认全球退党服务中心签发的退党证书是强有力的支持文件，并将退党证书作为中国公民移民、入籍等申请文件。
全球退党服务中心主席易蓉女士说：“中共在国内民心尽失，国际上面临全球围剿，天灭中共是天意是民心所在，所有加入过中共党团员和少先队，宣誓为共产主义奋斗终身，把生命献给党的人士，需要尽快在退党网和大纪元退党网站上登记退出中共党团队。”
易蓉女士还说：“全球退党服务中心还可以给在海外的华人提供中英文退党证书。退党证书终身有效。”
全球退党服务中心是在美国注册登记的非营利机构，中心的工作人员都是义工。因应三退（退出中共党团队）大潮，在美国很多大城市成立了退党服务中心，为华人提供免费服务。全球退党服务中心提供的一个服务项目，是为声明三退的中国民众签发具有法律效力的《退党证书》。
根据大纪元退党网站统计数据显示，截至2020年7月18日，全球范围内已经声明退出党团队的人数超过3.6亿人，达到360,138,814人。
