Former Chinese soldier gains NZ refugee status despite lying on visa application
A former soldier in the Chinese Army has gained refugee status after he came to New Zealand on a visitor's visa then joined Falun Gong.
The man, also a former Chinese Communist Party member, won the right to stay in New Zealand on appeal after an Immigration New Zealand officer declined to grant him refugee or protected person status.
Details of the case emerged in a judgment from the Immigration and Protection Tribunal following a February hearing.
The judgement, from tribunal member Moana Avia, shows the decision to allow the man to remain in New Zealand as a refugee came despite the tribunal's doubts as to his original motivation for coming to the country.
It also found he lied when applying for a visa.
The man, who said he was interested in travelling overseas because he was unable to while in the People's Liberation Army, arrived in an unspecified New Zealand city in June 2018 on a visitor's visa.
There, he met a Falun Gong practitioner at a market, saw adherents performing exercises and began learning about the group.
Falun Gong is a religious movement characterised by the practice of meditation, slow-flowing qigong exercises, a moral philosophy and strong opposition to the Chinese Communist Party.
Nearly three months after arriving in New Zealand the man applied for and was granted another visitor visa, valid until March 2019.
He visited the market again and met the same Falun Gong practitioner, who told him about the Chinese Government’s control of the media and persecution of the group.
The woman suggested he withdraw from the Communist party, which he appears to have done without much hesitation, having felt the party failed to appreciate him.
He found support from his wife for his newfound interest when she visited with their son in November 2018.
The following month, he took part in a Santa Parade as part of a 100-strong Falun Gong contingent.
In January 2019 he was told people in the local Chinese community spied on Falun Gong practitioners in New Zealand and had taken photos at the Santa Parade.
At this point he began to fear he was in danger from the Chinese government, he told the tribunal.
He lodged his refugee claim on January 31 and his wife and son left the country shortly after.
The man was interviewed by the refugee status unit a few months later but his application was declined.
He appealed on August 22 and throughout 2019 took part in several Falun Gong demonstrations.
The tribunal heard he was worried about what would happen to him and his family were he to return to China, but said he would not give up Falun Gong.
An experienced Falun Gong practitioner gave evidence that the man was genuine.
The witness said the man was likely to be arrested and placed in a brainwashing programme were he to return to China.
However, the tribunal found various issues with the appellant's evidence.
He said he came to the country for tourism but before his arrival he made no plans to travel outside the city, it said.
He also lied about the extent to which he had travelled when applying for a further visitor visa.
Without more evidence, the Tribunal could have concluded the man's claim was the product of a predetermined effort to find any way to remain in New Zealand indefinitely, its judgement said.
But its concerns were outweighed by the evidence given by the experienced Falun Gong practitioner.
It accepted that over time he became a genuine adherent.
The judgement said since 1999, the group has been considered an “evil cult” by Chinese authorities, who outlawed its practise and conducted a systematic campaign to eliminate it.
Falun Gong practitioners were arrested, detained in re-education centres, tortured and unlawfully killed, the tribunal said.
It also accepted members of the Chinese Consulate staff regularly photographed people attending Falun Gong demonstrations, and that the man was likely among those photographed.
Accordingly, the tribunal found the man was a refugee within the meaning of the United Nations 1951 Convention Relating to the Status of Refugees and allowed the appeal.

我其实个人认为这没什么。一个武警,敢于到一个民主国家申请庇护本身就足以成为其受到庇护的理由。美国和英联邦国家大体都是基督教立国的,愿意善待每一个没有恶意的人。
他愿意来到一个新西兰应该是心里难以接受以前的生活,对以前的职业有忏悔。就算他曾经是武警,我相信他也是不愿意手上沾着血的。只要这个武警不是间谍,身上没有背着血债,又不属于有组织的一大批武警化整为零的分散渗透,那就没问题。就算他不相信法轮功,来到一个新的国家从头开始生活又有什么不对?他可能会成为一个像大家一样辛苦谋生的人,那又如何?只要他不是来搞破坏的,那么就请善待他吧!

苦读四年的学生走中高端技术移民难度非常大,还不如说个谎,练一下法轮功来的便宜快捷,什么世道啊。
英联邦国家都对各种政治避难很友好,而且英联邦整体,曾经拒绝过因为任何政治犯罪对一个人进行引渡。如果真的下定决心离开共匪国,加拿大是个不错的选择。据我所知以前共匪限制生育那会,曾有多个怀孕二胎的孕妇请求加拿大的政治避难,加拿大同意了其中不少人。

利用法轮功也得去看他们的书和练法轮功吧,哪那么容易造假。只是好奇他怎么弄到旅游签证的,军人不是有限制?退伍多少多少年内不准出国什么的。
