我觉得三级谋杀是成立的，但二级谋杀就不太好说了。
二级谋杀应该是指临时起意，但是有主观谋杀意图，我觉得这个案子应该挺难证明警察有主观意图的。

每次击退美军，靠的都是数倍乃至数十倍的兵力，靠人海战略，完全把美军切割包围，最后还屡屡能让美军成功撤退。
一提到人海战略就总有粉蛆五毛冒出来否认，还说什么三三制——这纯属胡搅蛮缠——三三制和人海战略并不矛盾，共军既是三三制又是人海战略——每波攻击冲上去的士兵是不多，但会分很多批持续攻击，去送死的人数总量是一样多的，这是双方的战史里都有明确记录的，没有丝毫可质疑的余地。
共军就是通过超多批次的冲锋，用人命消耗美军的弹药，美军往往是因为弹药耗尽而撤退的，在美军的战史里经常写到，中国军人虽然每次冲上来的不多，但能不断持续冲一天，直到他们的尸体在美军机枪射程内堆成小山。
美军士兵感到可怕的主要是因为杀人太多，又不像打日本人那样有报国仇家恨的心理，才导致心理出问题、士气崩溃。
更何况朝鲜战争远不是中共靠自己打的，没有苏联支援的空军和武器，根本不堪一击。
